1. Introduction

Nima Energy AB (referred to as “data controller”, “we”, “us” in this document) and its subsidiaries work to ensure that you feel secure when providing us with personal data and when using our services. We are responsible for processing your personal data in accordance with applicable laws and regulations, ensuring that the processing of personal data is only used for intended purposes and is protected against unauthorized access.

2. Who is responsible for your personal data?

Our privacy policy applies to Nima Energy AB (559262-4166) and all companies within the Nima Energy group. The data controller at Nima Energy AB (559262-4166) is responsible for the processing of personal data.

3. What personal data do we process and why?

When you use our services, visit our website, use our mobile app, our web-based user portal, or otherwise interact with us, you may be asked to provide information to us.

We collect personal data when you, as an individual or your company, become a supplier, customer, or stakeholder to us, contact us, or subscribe to newsletters. This may include contact information such as phone number, email address, organization number, or personal identification number. Information related to the use of our services may also be collected, such as purchase information and billing address. For billing to companies/organizations, organization number and, if necessary, VAT registration number are also stored.

For registered customers at Nima Energy AB, we process additional information such as usernames and passwords. When you as a registered user use our services, we save information regarding charging history, including location and time, to provide a basis for invoicing and to track your use of our services. As a user, you can also add additional information to improve and enable the use of services (e.g., billing references, vehicle information, RFID tag numbers).

While charging, we may make coverage reservations to ensure payment capability. If necessary, we carry out credit checks for companies and individuals, normally by collecting data from third-party sources, such as public sources.

When using our services without a registered account (one-time payment), we or the payment service provider process your payment information. We may also collect additional information required by applicable national legislation (name, email, address).

Through our mobile app, we process data necessary to deliver our services to you, and for our legitimate interest to improve the user experience. We collect the device’s identity (if applicable) and status, search for and confirm access to available charging stations/network connections. In order for you to use our services, we collect location information to, for example, locate charging stations. In connection with the use of our charging stations, we may request access to your mobile camera, for example, to activate an individual charging station via a QR code, always with your consent. If you are logged-in as a registered user, your information is used to identify you in case of any support matters. To improve the user experience in our app, you can choose to share anonymous analytical and diagnostic data with your consent. You can choose to disable this function or deny consent.

We also collect personal data when you visit our website using cookies that collect information on and from your browser. This may include, for example, various electronic identities (such as IP numbers) if they can be linked to a physical person. We also use third-party cookies through analytics tools such as Google Analytics and Google Adwords, in the form of both temporary and permanent cookies. Permanent cookies are stored on your computer or mobile device as files for a maximum of 12 months unless you delete them through your browser or other required means. You can choose to reject cookies by adjusting the settings in your browser. Please note that some features on the website may be limited if you choose to disable cookies. When using our location map, we may collect location information with your consent. In the context of any support issues, cookie files are collected to identify you as a unique user. When you submit a support request, we process your email address and/or phone number or other information to be able to provide feedback on the specific issue.

Through our web-based registration portal, you can also register for our service (similarly to the app). In connection with such registration and use of the web-based registration portal, we process your data as otherwise described in this privacy policy. When using our web-based registration portal as an unregistered user, we process your information as described above for use without registration with one-time payment (see point 3.5).

We also collect information in connection with recruitment processes and employment.

We also obtain personal data from other sources – for example publicly available company and personal registers, registers used for credit assessment, and from other collaboration partners as needed.

As a rule, we do not collect and process sensitive personal data and extra protection data such as personal identification numbers, account numbers, or similar, unless it is necessary.

4. What do we use the personal data for?

To process data, there must be legal grounds under applicable data protection legislation. This means that for our processing of your data to be lawful, it is required to be: a) necessary for the performance of a contract with you, or b) necessary to fulfill a legal obligation, or c) deemed lawful, based on a legitimate interest, to process your personal data. , or d) approved by you for the specific processing.

To provide services and collaborations, we need to process and manage your data. Below are examples of the purposes for which we process your data and the legal grounds on which we do so: a) To enable us to administer and deliver products and services according to the agreement. b) To enable you to deliver services and products to us according to the agreement. c) To enable us to communicate with you before, during, and after an agreement or collaboration. d) To register you as a customer/collaboration partner/contact person. e) To identify you as a customer/collaboration partner/user. f) To answer your questions and inform you about new, changed services/products/procedures.

5. How long do we store your personal data?

We store your data for as long as necessary to fulfil the purposes mentioned above or if we are legally obligated to do so.

We never store personal data longer than necessary. Customer data is stored as long as you are a customer and for a maximum of 12 months after the contractual relationship has ended. Exceptions apply to data that must be stored for a longer period according to the law, such as the Accounting Act, or if the data controller’s contractual obligations towards a third party require a longer retention period.

To offer you attractive market offers, and collaboration proposals based on your needs, we store certain personal data, such as contact information, for up to 36 months.

6. Who has access to your personal information?

Personal data may be transferred to external parties that process personal data on behalf of the company and according to the company’s instructions. Such external parties are data processors and are always required to sign a data processing agreement with the company.

In various areas, we engage other suppliers to be able to deliver products and services. This means that they also need certain information about you as a customer. However, these parties are not allowed to use data about you for any other purpose than to provide the product/service or as specified by us. In some of these cases, Nima Energy acts as a data processor and has signed a data processing agreement with the supplier.

Personal data may be transferred to external parties with their own data controller responsibility without a data processing agreement when there is a legal basis or legal obligation for the transfer. The transfer shall be documented, and only necessary information shall be transferred.

We never sell, exchange, or broker your personal data with third parties, except as outlined in this policy. However, the distribution of marketing materials and the collection of statistics are sometimes handled jointly by us and other companies within our group.

7. Where is your personal information stored?

The data we collect is stored within the EU/European Economic Area (EEA), but it may also be transferred to and processed in a country outside the EU/EEA. Any such transfer of personal data is done in accordance with applicable legislation.

8. What are your rights?

You have the right to request information about the personal data we have about you, free of charge, at any time. If this data is incorrect, you can request a correction. You can also request the deletion of your personal data, provided that the data are no longer necessary for the purposes for which they were processed, as outlined in GDPR Article 17. You may also request deletion of your personal data if the processing is based solely on your consent and you withdraw that consent, if you object to the processing based on a legitimate interest, and there are no overriding legitimate grounds for the processing. However, legally required data cannot be deleted.

Some data processing is based on your consent. You always have the right to determine which processing activities you consent to and to withdraw your consent at any time. To provide services and fulfil contracts, we need to process and manage your data. However, you are not obligated to provide your data to us. If you choose not to do so, we may not be able to provide all our products and services to you. You always have the right to withdraw your consent for the use of personal data and to opt out of targeted marketing. For individuals under the age of 18, consent must be provided by a parent or guardian.

You have the right to have your personal data transferred (portability) for use elsewhere, where technically feasible, in accordance with GDPR Article 20. This requires that the processing is based on consent or that it is necessary for the performance of a contract with you.

You have the right to request the restriction of the use of your data if the requirements specified in GDPR Article 18 are met.

As a user, the data subject, you must submit a request for the enforcement of the rights to info@nima-energy.com. Nima Energy AB may require you to specify your request and validate your identity before processing the request. Subject to exceptions as prescribed by applicable law, Nima Energy AB may deny the execution of the request.

9. Security

It always carries a risk to disclose personal data via the internet or telephone, and we continuously work to protect the privacy of our customers, suppliers, and partners. No system is completely protected from intrusion. However, Nima Energy AB has implemented reasonable technical security measures that may be required to protect personal data against unauthorized access, alteration, and destruction. Our security measures cover protection for individuals, information, IT infrastructure, and our premises. Special attention is given to information security regarding your data to prevent, deter, and detect its disclosure to third parties or loss. Access to your data is granted only to those who need it for their job responsibilities.

10. Notification of violation (complaint)

If you believe that your data is being processed in violation of applicable regulations, you should notify us promptly. You can also file a complaint with the Data Protection Authority.

If you have suffered damage due to your data being processed in violation of applicable laws, you may be entitled to compensation. In such cases, you can request compensation from us or file a lawsuit for damages in court. Such a request should be made in writing to us.

We may update this privacy policy from time to time. Any changes will be posted on our website and will take effect from the date of publication. We recommend that you regularly review the policy to stay informed about any updates.
